GUIDELINES
H1B VISA Processing
DISCLAIMER: These are suggested, functional guidelines. The NWD-DOL is not responsible for incorrect petitions filed with Citizenship & Immigration Services (CIS). Petitioners must consult CIS or an immigration attorney for counsel on specific petitions and current fee structure.

  1. Complete a Request for Prevailing Wage Form.
  2. Complete ETA9035 Labor Condition Application.
  3. Print Certified Labor Condition Application.
  4. Complete I-129 and H Supplement.
  5. Complete I-129 W Supplement (if applicable).
  6. Include both filing fees:

    Must Submit Filing Fee AND I-129W (ACWIA) Fee
    For most employers with 25 or less full-time employees: $1,070.00 ($320 + $750)
    For most employers with over 25 full-time employees: $1,820.00 ($320 + $1500)

    In addition, employers must pay a $500 Fraud Prevention and Detection Fee.

  7. Include the following documents with the I-129:

    Letter to CIS listing proposed employment information, including:
    • name of employer
    • position title
    • position description
    • essential duties
    • education
    • training requirements
    Foreign worker’s credentials (attach copies of transcripts)
  8. Copies of current or previous H1B Approval Notices (if applicable).
  9. Information about employer’s business such as copy of web site.
  10. Copy of budget or tax return to show ability to pay.
  11. Mail I-129 with all documents to USCIS (address will be listed on their web site)
  12. I-907 Premium Processing (if desired within 7-10 days):
    Mail this form separately with $1000 check or money order to:
       USCIS. Check their web site for mailing address.

New Work Search Log
Effective March 15: If you receive unemployment benefits and are required to complete a work search log, you may log your work search contacts as soon as you make them, before you file your weekly claim. You can no longer record your contacts AFTER you complete your weekly claim for benefits.
